It seems pretty extraordinary, the Republican lawyers seem to be pretty openly saying they want to cause a big mess over nothing that's concrete? Aren't there rules against vexatious litigation?

That's huge. If Scott secretly allowed email/fax voting in Republican-margin districts under the auspices of helping hurricane victims but didn't allow email/fax voting statewide, that's an unprecedented level of structural partisan favoritism (well, unprecedented since the VRA).

I remain presently surprised by this. I've gotten so used to hearing partisan hack decisions where the GOP seems to get their way in the end no matter how bullshit their case. It's nice to have something so emphatically decided against them and their anti-democratic bullshit with an added opinion that they should maybe tone down the rhetoric and BS for the sake of the American people. Judge doesn't sound impressed at all, but then any judge who has that case put before them by a state governor without any evidence or cause whatsoever, other than shamelessly and nakedly trying to hold onto power the easy way, SHOULD react with that kind of decision and opinion IMO.

The big question is how many of these e-mail votes did they count? A few hundred probably won't change much.

It's also astounding that they allowed it considering vote by e-mail is specifically banned by Florida law. That only one county was allowed it makes any lawsuit against it easy to win too.

Scott trying to claim that they should do what he wants because the public has lost confidence in the election, which is solely due to his own negligent actions, is a farce and I'm really glad that judge laughed him out of the room.

Also holy poo poo if that email story is true. The site it links to is really janky though and I'd wait until someone more reliable runs the story to get outraged.

I'm starting to think Florida in and of itself is the only argument you need to make to get the VRA reinstituted and bolstered, if there's a political will for it. Write it in such a way that both sides see the merits of everyone registered, then you get out there and do your thing.

That's not what the current entrenched power wants. But the alternative is a bit more grim.

Wow. I'd be really interested to find out what happens there. I've had to fax my ballot in FL the last few elections, and the instructions from the state are super clear "we will not accept a ballot sent by e-mail"

Edit: Here's the exact language from the e-mail I received from my county "If you are an overseas voter, you may choose to fax your ballot back to our office. Fax the completed ballot and signed and dated certificate to us at ***-***-****. This ballot MUST BE FAXED NOT EMAILED."

If the voting by email issue can be demonstrably shown to have only applied to primarily conservative areas, I imagine that would be another big court case in a close race. But I don't know if either of the democratic candidates would pursue it when they could still possibly win regardless. It would probably be a case that appears after the rest of the votes are counted.

The Today video is down but going by the WJHG video, it sounds you're right - it was probably just a couple of hundred votes. The SoS is claiming that they forbade the local election official from offering email voting, so it doesn't matter too much for the election in general, but those voters were screwed by the local election official and he should probably face legal consequences and communications with the SoS should be subpoenaed if there are records.

To be fair, Russiagate is perceived in an extremely partisan manner, so you'd expect the vast majority of Republicans to not care about it to begin with (which would automatically make it rank lower than most things that people from both parties might care about, like healthcare, the economy, etc).

This is saying 'For the sake of argument, even if we did it - which we are not admitting - we would be immune from prosecution.'

It's not an admission of fault, it's them formally declining to waive their sovereign immunity from this kind of suit (and also no one's going to get charged with treason for like any reason due to the incredibly high standards for that charge).
