Department of Education is reforming rules on how sexual assault is investigated on college campuses so the real victims are protected, the accused.

My dad grew up in Arizona so Goldwater was his senator, and he basically worships the ground he walked on. He loving hates Trump, but he keeps holding Goldwater up as the exemplar of what Republicans should be. I've tried telling him that Goldwater is the reason the GOP is the way it is today, and that it was wrong of him to oppose the CRA, but all I get out of him is "well he actually wasn't racist and he said he regretted the decision [long after he retired from politics of course]".

I'm definitely glad he's not a chud, but the centrist garbage can be really frustrating. After the midterms he told me that he hoped the Dems learned the lesson that they need to run more moderate candidates rather than "hardcore progressives" like Gillum and O'Rourke.

If we had a parliamentary system there would be room for a centrist party. It would be garbage poo poo for idiots and we would introduce all sorts of new problems switching to that system, but at least we wouldn't have to be all in on "liberal" values and "conservative" values. As it stands right now both parties are largely just loosely organized coalitions and every now and then a central theme coalesces long enough for them to do something about it.

nz's system isn't perfect but the way it normally winds up working is that you get two larger parties that need the votes of the smaller, more radical parties to gain power

assuming good faith actors (which to be fair, most of them have been so far) it means you tend to get better results than just from one party that doesn't have to give a gently caress

Why is it up on colleges to investigate at all? Shouldn't this be a matter for police and judge/jury in a criminal matter and then for the college to penalize or not based on court findings?

I'm probably missing something, but I am convinced my college has the worst admin services and have hosed up everything from my transfer to my pending graduation at least once so trusting them to handle something like that is not something I'd take on faith.

The old regulations were a massive overcorrection that cost universities hundreds of millions of dollars in lawsuits for doing stupid poo poo to students during disciplinary hearings. They really did need to be overhauled, although I'm not confident that DeVos is the one who should be leading the effort.

Colleges generally have a standard of behavior they expect of their students. This can cut both ways.

On the one hand, it means they could still punish a student who committed a crime or unethical act who got out of a conviction based on technicality, a deal, or being buddies with law enforcement. See also: colleges that find an administrative way to punish on campus underage drinking or minor vandalism and disorderly conduct without inviting the police into dorms to ticket and arrest people every weekend. (My personal college experience was an admin that erred on the side of telling cops to get bent if they wanted into the dorm without a good reason)

On the other, something as serious and difficult to prove as sexual assault isn’t something their administrations are typically well equipped to handle in a great way. In some cases they’ve kicked out some real bad dudes. In others it’s been literal he said vs she said where the accused doesn’t get to face the accuser then gets expelled without any physical evidence.

Where it’s probably really hard is if you have an accused who has been accused multiple times but never with criminal court actionable evidence. Saying “let the cops handle it” won’t sit well if you’ve got someone accused several times, but who’s too clever to get nailed by cops. That’s when the power of administrative action is super attractive.

The best theory I've heard is it's a :decorum: thing on behalf of Mueller. Since it didn't really do any damage because the news cycles hardly picked it up and quickly forgot about it, he didn't push things. Maybe. Nobody knows.

edit: Bastaman will absolutely positively go after Wohl for filing a false police report though, and probably sue him for defamation
