And for people whose time horizon is short enough to still be deep into equities but not long enough to weather a huge crash unscathed we could maybe, just maybe, bailout the average American and make them whole. I was being sarcastic but not trolling. I'm pointing out that every day that goes by gets closer to the 2020 election. The Republicans made up the idea that a President is not allowed to nominate a Supreme Court Justice close to an election, but they never specified exactly how close. I have a sneaking suspicion that if it's a Republican President the answer is "they can nominate somebody up to the day their term ends".

Cry Pres settlements are really not bad at all. The important part of a class action is creating an economic incentive for the company to abide by the law even where the harm to individuals is very small, who actually receives the award is not that important because the harm to the plaintiffs is nominal in any case.
