Illinois supreme Court denied motion by prosecution in Van dyke for leave to file petition for writ of mandamus or prohibition

No majority opinion, a couple dissents

The trial judge cited a dissenting opinion in sentencing so gently caress it, why not, the law means nothing and dissents are good law too

I get that technically the mandamus/prohibition are probably not the correct remedy but surely some sort of remedy should exist here (supervisory order is what the dissents said should be used)

Merger is usually a matter of discretion for a judge in sentencing. Is it not so in Illinois?

And not really case dispositive, so would the State have a right to appeal?

This week on Elected Judges and the American Criminal Justice system: Nowata County (OK) sheriff, staff resign over safety issues with jail; sheriff alleges judge tried to bribe her to keep it open https://www.tulsaworld.com/news/sta...80c8ae59bf.html

After maybe being ordered by the judge to re-open the jail and refusing to comply...

quote:

“[The judge] stated to me, ‘Let’s say you go to Greece for two weeks, and when you come back, the jail is open and has passed all inspections and the prisoners are returned.’

“He also stated to me he felt like he could get my salary up to around $75,000 in order for me to increase the salaries of employees who work in the Sheriff’s Office. I advised the judge at that time my salary is dictated by statute. He also stated he could put paperwork in place for me that would protect me from all personal liability involving the jail, which I know he cannot do."...

Barnett also cited the following issues with the jail:
• It does not comply with constitutional standards.
• The fire alarm system as mandated by the fire marshal is not in place.
• The cause of the carbon monoxide issue, which required four employees to go to the emergency room, has not been determined.
• The wiring is exposed in shower areas and throughout the jail; inmates have been shocked.
• There is mold throughout the jail.
• Plumbing is improper with improper sewer lines; methane gasses seep in.
• A snake fell on a prisoner’s head after a jail door was opened.

My home state of Oklahoma is a pre-post-apocalyptic wasteland. So many in jail, and no one willing to pay taxes. 10 elderly for every 1 working adult. A populace to dumb to function. Texas companies send all the roughnecks to take oil and gas for cheaper than they can get anywhere else. We let them because it hastens climate change, and thus the sweet embrace of death.

This is so true. I remember going into a casino once in Deadwood, on the way back from seeing the Badlands and Little Bighorn.

I go in thinking, “Deadwood, this will be fun, I can have some drinks, play some poker, whatever.”

Middle of the day in tourist season. Not a single poker table running. Just some desultory olds pumping nickels into slot machines. It was like a post-apocalypse movie - eerily quiet, except the quiet chinking of a few zombies mindlessly picking up the next coin.

Yeah, the casino part of Fallout: New Vegas is actually modern day accurate.

The only place I've been where the casino was not depressing as gently caress is Tunica, surprisingly. (I have not been to Las Vegas) The riverboat casinos I went to in Indiana and Nebraska (especially) were just pits of human misery.

Interviewed at a small class action firm in town. They have two old attorneys and one junior. The junior is leaving for a job in a different part of the state near home so they’re trying to hire someone asap. I’m the only person they’ve talked to, and they all but offered me a job. There doesn’t seem to be any major pitfalls or drawbacks to this job except that the firm will close and cease to exist sometime in the next 5-10 years when the old couple retires. I also don’t know what type of pay they’re offering.

The old dude was bitching about Trump, the federal arbitration act, and the bullshit conservative bent of both the federal and state supreme courts so I know we’d get along on that front.

When I was a PD we .6ed judges fairly often. They didn't take it that personally unless we blanked challenged them, which only happened twice. (One the DA's office joined us due to the judge being a creepy harrasser.)
