I believe that anywhere with two-party consent, it becomes legal to use anything that is recorded as soon as the other person knows they're being recorded. The problem is that you could theoretically get in trouble for what you recorded before they found out about the recording. That being said, there's absolutely nothing illegal about whipping out your phone in public to record something. Some states make it illegal to secretly record stuff in public, but there's nothing secret about pulling out your phone and visibly recording someone right in their face.
