Herstory Begins Now posted:I'm legit surprised, I figured that for sure a shitfaced cop walking into the wrong apartment and gunning down a black immigrant eating icecream was a sure bet to get acquitted. That entire story was so weird, like there were either a dozen layers of outright wild, insane incompetence and terrible judgement or she was actively planning on killing him Was it verified that she was intoxicated? Did she ever get alcohol or drug tested after the shooting?

Mahoning posted:Doesn't Texas also have a special capital murder category if you kill an elderly person? (Not that Botham Jean was, just saying I remember it from my countless hours of watching Cold Case Files and Forensic Files) You might be thinking of killing a young child. I'm not seeing anything regarding the elderly in capital / first degree / second degree. Here's the full capital murder list (paraphrased so it has fewer big words): quote:The victim is a peace officer or fireman who was acting under lawful duty at the time of the crime; fake edit: looks like they raised the age to 15 this year

Zwabu posted:Was it verified that she was intoxicated? Did she ever get alcohol or drug tested after the shooting? I could've sworn it was done a decent while after the shooting, but I could well be misremembering. Plus I thought there were reports of her seeming really out of it afterwards, and moreso than you'd expect after a shooting. At the end of the day it doesn't change much if she was or wasn't drunk since either one is equally horrible.

That's pretty extraordinary for a cop. I wonder if it was the sum total of all the weird facts and poo poo or if they had especially damning texts or something. murder 2 really, so probably 25 to life or whatever texas looks at

This is an amazing power play because it's fairly obvious that the grand jury DOJ was relying on fell apart on them. Edit: Not that we will ever know, but this judge clearly knows enough to make a statement. Retro42 fucked around with this message at 18:04 on Oct 1, 2019 |

I was brought in for jury duty in this case (along with 800 other people) and they spelled out why this is felony murder (not capital, that's the one with life and death sentences).
