I may regret this, but, as a homeowner's insurance adjuster, I'll attempt to contribute & clarify:

There are two parts to this.

1) What the cops did was egregious and indefensible, and another example of runaway police 'powers' that have remained unchecked for far too long.

2) The actions of civil authorities to keep the peace and protect lives and property* are typically held to be immune from civil suits under sovereign immunity laws (Title 59 rules in NJ). In Philadelphia, for example, the police & fire departments used to be extremely, uh, proactive in gaining entry to a fire house (no knock, axe first, bye-bye all windows). They're getting better about it, but that would invariably be part of the scope of my estimate for fire damage ("fire department activity") since, of course, fire suppression water damage is also covered.

Most insurance policies exclude damage that ensues following an order or decision by a civil authority. In my experience, we rarely invoke this exclusion. Technically, the homeowner's insurer could have denied the structure claim. It was wise of them that they did not. After 9/11, we had meetings to discuss corporate's decision whether or not to deny ensuing claims in the WTC complex and the surrounding affected neighborhoods because the Bush administration immediately declared the occurrence an act of war; damage ensuing from acts of war are excluded. They correctly ruled that this was a one-time thing despite the declaration, and waived the exclusion (Can you imagine the shitstorm if they had not?).

In the MOVE bombing, the city found it to be, ah, in their best interests to cover the rebuilding of Osage Avenue.

In both of the above instances, the insurers and the municipal government elected to do the right thing because of the wide-spread scope of the damage, with hundreds/thousands of affected individuals, not to mention the publicity.

In the end, however it's a political decision.

In this instance, the insurer paid to rebuild the structure. It has no right of recovery in subrogation against the municipal government; while they'll send an initial demand letter, their recovery efforts will proceed no further once they get the denial letter back. Nobody cares if the insurer gets their money back.

The municipal government offered to cover the deductible. This is a common offer, I've had it happen on numerous claims of mine, both involving police & fire dept activity as well as motor vehicle collisions. They will typically offer no more. Since this involved a single home and family, they made the political calculus to stop there. I'll don my extreme cynic/rear end in a top hat hat to say, though, had someone died, the municipality would likely have jumped right in on this.

With respect to the municipality criticising what the homeowner did as far as rebuilding: Bad move, assholes. If you'd done the right thing at the outset and paid the rebuild costs, you'd have no complaint about how the home was rebuilt.

With respect to the suit: The premise of taking may not have been the best legal strategy, although (as noted in the article) there are a fair number of precedent cases to bolster the argument. However, none of these appear to be in Colorado (which is probably why they filed this in federal court rather than the local/state venue) I'm guessing that there are even more with the opposite decision. Maybe this was the strongest legal argument they could make rather than asserting liability due to non-proportional use of force.

Finally: It sucks that they are not compensating the tenant. All I can say to that is: get an HO4 if you're renting. Most tenants don't. Get it, It's cheap.
