So a partner at my firm called me in and said I've been doing well and everyone's pretty much agreed to making me partner by the end of next year. My girlfriend and I have been trying for a kid the past few months and she told me this evening that she's pregnant.

So yeah good day all around.

I took testimony for the first time today.

It was a really short cross-examination; but I didn’t completely screw anything up (as far as I know), so I’m considering it a cause for celebration.

That guy owns. Reading nothing about the case this sounds like a lawyer looking to get admitted in some jurisdiction/district that needs affidavits of fitness in support of his admission, and one of the affidavits he got from another lawyer wasn’t flattering, and he’s complaining that his due process rights were violated because his own affidavits got him dinged? Lol

“Rebuttal, judge?” Hahahaha

E. Lol it’s even better, looks like he picked a constitutional fight over the local rule requirement that his sponsor for admission has known him for at least a year and attests to his good character.

I assumed the guy in oral arguments was the same guy who didn't get admitted. However, the COA justice says to the attorney "your client controls whatever affidavit he submits..." so did some bonehead attorney who failed to get admitted due to his own affidavits hire ANOTHER boneheaded attorney to appeal the issue?

His argument, which got 12(b)(6)'d:

quote:

First, plaintiff challenges the foundation of the federal courts’ authority to adopt rules
governing the admission of attorneys by arguing that Local Rule 1.3(a)’s sponsor affidavit
requirement is the result of an unconstitutional delegation of power by Congress to the Judiciary.
Second, he claims that the sponsor affidavit requirement contravenes the Fifth Amendment’s
Due Process and Equal Protection Clauses. Third, he alleges that it violates his rights under the
First Amendment.
None of these claims have merit.

My first cross examination was of a patent infringement expert. We thought it was for a minor patent, but it turned out they re-jiggered their damages analysis and that patent ended up being the most important one. Then the jury asked for my cross examination to be read back to them. Then they found in favor of my client.

It worked great, not as full as I imagine cream would be but a noticable and delicious flavour. I used too much nutmeg, but the drink itself was great and it turned out simple syrup is easy to make! (It's basically sukkerlake). I feel ready for the office christmas party now.
