If that had happened to airplanes under ATC control, for instance between aircraft flying IFR, then it would be a loss of separation incident and yes it would get investigated. It was done specifically to prevent shite quality stuff hitting the the international market and damaging China's reputation during this time. In a few cases, goods were seized at the border because of the counterfeit CE mark, and were released because the shipper/seller was able to argue that "It's not a CE mark, it's a China Export mark, look they're clearly different!". Apparently it was brazen enough AND legalistically valid enough for them to get away with it long enough for it to become a thing the actual CE people have to describe and disclaim. poo poo, for a while there, you could see the fake CE mark on CFL/LED bulbs at Lowes/Home Depot, and shocking nobody, they lasted about 3-10% of the 10k hours claimed on the cover.
