Question for joat mon: how much does the precise cause of death matter to charge here? ie, whether he died because he was choked by the cop or had a panic attack then heart attack due to excessive force by the cop or what.

Detroit was doing basically everything right - handing masks to the protestors, escorting them around, and generally being agreeable. Things are starting to get a bit frosty because they arrested someone and rather than explaining why to the crowd, the crowd swarmed the car and won't let it leave. They're trying to get people away with horses but uh, yeah.

There was a confrontation outside the White House a little while ago where some DC cops grabbed a guy out of the crowd and then got chased into the Freedman Bank Building, it's quieted down a little now but there's a good sized crowd in Lafayette Square.

Yeah how does this work given that the officer was armed, had his gun drawn at one point per the report and the guy died. There was a case in WI from 2018 where a armed robber holding up a burger joint had someone die of a heart attack getting hit with murder charges.

Can joat mon or a lawyer explain why the exact "cause of death" matters in terms of culpability or punishment? Yeah, okay, he had underlying conditions, and that, combined with the combination of what the officer did, killed him. Why does it matter that there were no strangulation marks or whatever?

Whatever underlying conditions the guy had doesn't matter (or shouldn't) - the actions of the cops still caused the death. It's not like his underlying conditions caused his death suddenly at that exact moment without outside action. Just like positional asphyxiation killed Eric Garner specifically caused by police action (and inaction when he stated he couldn't breathe), George Floyd's death was directly attributable to that cops actions.

Not to mention the other two cops were on top of him (not needed at all after he's secure in handcuffs, unless he's flailing around/kicking, in which case you secure his feet and place him in the goddamn cruiser, not hold him down for 10 loving minutes like psychopaths), and the other one, who didn't take responsibility and tell the main guy "hey man, I got this, back off a little" or do literally the least anyone could do / anything to stop him.

Can an attorney explain why the exact cause of death matters?

Denying medical attention seems to be a recurring theme in these incidents, be it respiratory distress or letting a shot person bleed out. I have to assume on some level it's a power thing because at that point the individual is thoroughly subdued, if they weren't already.

As far as not giving medical treatment to people, yeah, it is loving pathetic that some agencies don't immediately start first aid immediately after securing the suspect / the scene. Cuffing people and letting them bleed is loving insane to me. Since I left the law enforcement world, I started to watch a lot of bodycam vids on Youtube, and some agencies do perform first aid on suspects after shootings or any use of force. A lot just don't, and wait for medic/FD/EMTs to arrive. That needs to change, nationwide.

Back after the Eric Garner tragedy, all LEOs in NYS (local, state, municipal, sheriff, Corrections) was taught about positional asphyxiation in the yearly defensive tactics refresher, and all academies were changed as well.

There is literally zero excuse whatsoever for a cop to kill someone with positional asphyxiation after Eric Garner. That should've been a wakeup call to literally every LE agency in the nation. It largely was, but unfortunately there's still power tripping pieces of poo poo in LE.

ideally yeah, some of that stuff is going to be a pain to get what with the rona eating up all the supplies of really good masks and such

most of the other protective gear would be easier to get though and an actually decent backpack isn't that expensive anymore. something that could carry 30-40 pounds of gear comfortably is enough

Toxicology panels can take weeks sometimes months to return from the lab in most places. Even in high profile cases results can be a while for the ME return. That's why they usually write it preliminarily like that ie. can't rule in or out as the results are unknown.
