I made a Youtube video about police and military use of the Punisher logo a while ago. At the end, I tried to speculate for a bit why Disney isn't litigating that issue, coming up with a handful of possible reasons.

I never expected "they actually think it's good and are fine with it" would be the real reason. :negative:

I’ll give a half-hearted defense of Disney and point out that challenge coins are almost never the sort of thing that are officially produced. A group/unit type coin like that would be more of a fund-raising type deal to pay for an office pizza party with no input from Disney corporate.

Also, Disney has a gently caress ton of rules dictating how their characters are used. They've forced pre-schools to paint over playrooms with their characters "no putting Mickey Mouse ears on a loving skull" doesn't seem out of character for a rule about employees making items that identifies them as theme park employees.

Having worked for the rat back in 2005 a) Parks is very much fart sniffing tryhards who revel in the company’s IP and embarrass the gently caress out of the rest of company (Films and ABC back then). Things like buildings having conference rooms named after Disney characters (Like Stinky Pete, Pokey, or Green Alien) that were fresh when the building was built / renovated. b) Disneyland is a special kind of “magic” place where the farts are sniffed harder and the employees... I mean beloved cast members... are super into it. They all knew Walt personally or their second or third generation Disney emplo... cast members... so this kind of hosed up poo poo is just background noise to them. They’re genuinely oblivious to larger world most of the time. IME Maintenance and Security always had the longest tenured people, after a while you just kinda got moved there and so these unofficial trinkets were not uncommon and especially prized by those that had them.

If I had a guess the idea was suggested by a newer guy, approved by middle management, made by a friend of a friend and passed out without really stopping to even think beyond the “it’d be cool” factor. If Burbank (main HQ were Iger and his top folk sat) caught wind of these kinds of things it got shut down hard, and I imagine some people are going to be “retiring” real soon as a result of these tweets.

The video was geared more towards the use of these badges/stickers/what-have-you than the production of them, so the angle I took was about why Disney doesn't try to litigate the issue with individual police departments. I didn't cover things like challenge coins or individual cops wearing Punisher stickers, but commissioners having the Punisher logo plastered onto all of their departments' vehicles and official department access tools using the logo. Structural IP abuse, in other words.

But I think you are on to something. Looking at all of these shops that sell thin blue line merch, they pop up and go under quite quickly. A quick Google search didn't lead me to find any that were launched before 2019.

In the comics they were more antagonists than villains. It was a government approved team lead by Mystique that would frequently fight the X-Men but also save people, a little bit like the Thunderbolts.

I wouldn't worry too much, the group in congress will almost certainly dissolve into infighting before summer. The Squad occurred organically when a group of freshman representatives realized they had similar congressional goals, enjoyed each other's company, and weren't getting support from their party's established leadership.

TakeTwo still has the trademark for "Freedom Force" and as long as they don't use "superhero" in the advertising and the characters look like rip-offs/homages instead of confusingly similar characters, Marvel/DC wouldn't have any grounds for a lawsuit.

I do think the possible reason for not doing a revival is that there are a bunch (of varying quality, but nonetheless) of actual superhero games with actual characters people already know; I'm kind of out of the loop of a lot of AAA video games but you also don't see nearly as many "basketball/baseball/football/wrestling/Star Wars with the serial numbers filed off" games as you did in the 8/16 Bit era, probably because everyone just buys Madden or the new Star Wars game instead.

The other thing I'm only thinking about right now -- and this is not founded in any facts and may be a borderline conspiracy theory -- but I wonder if this is part of why both Marvel and DC have gone so multiverse-crazy over the past decade or two: when Freedom Force came out there were probably maybe a dozen different distinct and enforceable "Spider-Man" looks that you could say look too much like Marvel's Spider-Man so as to cause marketplace confusion.

In 2020, Marvel and DC have created (and marketed in one-shots, mini-series, alternate covers, action figures, etc) hundreds of different versions of all of their marketable characters, so that you'd have to be incredibly careful not to accidentally market your video game with something that looks too similar to Punk Rock Spider-Man or Steampunk Wonder Woman or Soviet Superman or Cyberpunk Vampire Batman or Latinx Female Paramilitary Captain America that this might be more of a concern for would-be developers.
