e: I'm also not sure this is how things work, if you die without leaving a will (or leaving one that can't be found) I assume that (after taking a cut for taxes) they would just give the rest of his property/money to the family and let them sort it out. It wouldn't be given to charity unless his will said "If you can't find this will the money will be given to charity" but you'd need to have the will to see that it says that.

Maybe things were different in 1979, I don't know.

Weird wills are standard equipment in the hack mystery writer's toolbox. This reminds me of one of Isaac Asimov's Black Widowers mystery stories, where a dead guy leaves a will stipulating that his money should be given to the American Nazi Party unless his heirs can solve a puzzle. That'd be a heck of a better motivation.
