https://twitter.com/rawsalerts/status/1398855606291812352 Well that ain't good "Numerous people trapped inside burning oil refinery in West Virginia #Newell l #WV Fire and EMS personnel are responding to several callers who are trapped inside Ergon Oil Refinery. Witnesses report large ongoing explosions." Video mirror here in case the tweet is deleted. Apparently that's not the first time that refinery has been on fire this year.

NTSB: we found the issue to be that the brisge was designed intentionally wrong, as a funny joke, in order to amuse some members of the design team who quoted saying it was “hilarious”.

Flannelette posted:So when there is a court case do they look at the report then go and look at the same things the report looked and make a new report that just repeats it? It’s complicated. quote:In a civil trial, the admissibility of these NTSB reports under Rule 803 (8)(C) is specifically circumscribed by the federal “exclusionary rule,” 49 U.S.C.A. § 1554 (b), which provides that “no part of a report of the Board, related to an accident or investigation of an accident, may be admitted into evidence or used in a civil action for damages resulting from a matter mentioned in the report.” See Andrew J. Harakas, Litigating the Aviation Case, From Pre-Trial to Closing Argument 390–96 (American Bar Association, 3d ed. 2008). The case law reflects a split in precedent with many courts holding that the exclusionary rule prohibits admission only of NTSB opinions and conclusions, while allowing admission of factual findings. That’s for federal court, states would have to have their own exclusionary rules, but almost all aviation incidents would be “removable” to federal court anyway (e.g. because the airline you’re suing is based in Delaware and you’re not). So some circuits allow parts of NTSB reports. Others allow nothing. Theoretically SCOTUS should sort this out at some point. If someone is quoted in the report as saying something interesting, they would be subpoenaed and forced to testify unless they themselves are potentially at fault in the incident and can plead the fifth. Subpoena the investigators, too. It’s like kids learn in school these days. You can’t cite Wikipedia, but you can go to Wikipedia’s sources and cite those.
