It's considered incredibly tacky, in poor taste, a stain on the artist who is tracings reputation, and a disservice to the original artist.

Normally it'd be not great but whatever, it happens all the time. However she got invited to be a guest at the Toronto Comic Arts Fest (presumably by someone else into NFTs) which is why her extremely cool art and opinions have been put under the microscope

I think the actual law is a lot muddier than that for derivative works, but yeah if someone wanted to pursue legal action they could gum them up for a while.

I think it's rarely pursued in court because it's some combination of the original author not having enough to spend on counsel/violator has enough to take/case is too difficult to prove, but if someone is publicly selling copies and they admit publicly they are copies and if they manage to sell them for a lot of money :shrug:

"Derivative works" is a term of art in law, and in fact, in the US, derivative works can be perfectly legal if they're "transformational" (another term of art). If they're making a profit, a smart person does not publish a derivative work without consulting a lawyer.
