I think it's rarely pursued in court because it's some combination of the original author not having enough to spend on counsel/violator has enough to take/case is too difficult to prove, but if someone is publicly selling copies and they admit publicly they are copies and if they manage to sell them for a lot of money

"Derivative works" is a term of art in law, and in fact, in the US, derivative works can be perfectly legal if they're "transformational" (another term of art). If they're making a profit, a smart person does not publish a derivative work without consulting a lawyer.
