I think, looking at the Irish legal system, if you got all your union members to do it, and the management resort to calling the guards to report you for theft (which they likely couldn't since there would be too many people and the guards aren't going to go to every bus route to charge individual drivers. But let's say they did.) So if you got charged for Theft, under the Irish system it is a hybrid offence. Which means it get's prosecuted Summerily in the District Court (lowest level. Judge alone) unless the DPP or the Judge decide that it's serious enough to be tried on Indictment (in the higher Circuit Court. Meaning Judge and Jury, harsher penalties.) But due to Theft being a specifici hybrid offence, the accused can opt to place themselves on their right of election and be sent forward to the Circuit Court to be tried by Judge and Jury. If you could get striking workers to agree that if they are charged they sweat it out and make it go to the Circuit Court (that's a big if. It's a reverse Prisoners Dilema writ large) the number of cases going to the Circuit would likely put huge stress on the system. Not to mention that the trials would be conducted as huge media circuses designed to appeal to the juries sensibility of convicting their fellow workers. There is a lot of moving parts, and it would require nerves of steel to enforce but it could work. That being said the management at the companies would probably look at going after some alternative method (internal discipline actions over criminal conduct. Or seek to recover the costs via Civil debt reclamation. ) which would further convolute everything.

It'd be pretty trivial (if one were a rich/powerful oval office with access to waiting list skipping and a full choice of ENT specialists) to get a medical note saying that cocaine was used as the local anaesthetic for the sinus surgery due to an allergy or availability or none of your business it was a medical decision. Which then runs into the problem that you can't test for the illegal use of cocaine. (Or more likely he can just say 'no' and face zero consequences, but it's another example of why drug testing is usually bullshit.)
