I think the thing with this is that the $1B fee isn't a "I don't want to do this" option, it's a "I don't have the funds to do this" penalty. Musk isn't allowed to just go "eh, no" because he signed a contract saying he was doing it. It's just that Musk is the leader of a cult of personality, rich as hell (on paper), and is known for suffering no consequences for his actions.
