bigperm posted:6 hours of actual doom and gloom followed by 6 hours of punitive gloom and doom. Digital Jedi posted:I didn't expect $150M award or anything close to it. Maybe $30M+ or something. Yeah $150m compensatory was never happening, but I was expecting $20m or so. Maybe the issue is that my expectations about compensatory are out of whack. Popehat is usually pretty insightful on these sort of things and he argued that the verdict was actually on the high end. The real problem in that case would be that Texas has such aggressive caps on punitive damages, which is where "Bankrupt Alex because he's a shitstain" should happen in theory. ryde fucked around with this message at 23:10 on Aug 4, 2022 |

I'm reserving my judgement for the punitive damages compensatory are the ones that are literally compensating you for money lost, which wasn't much in this case. it's all about the punitive with this one. curious to see what that will be.

plantiff's lawyer indicated punitive could be tens of millions; there are also sanctions, CT, and the phone stuff - so it's far from over for the fat sack of red poo poo

I think the amount with regards to compensatory poo poo is kind of okay, like that's don't need to work ever again money. Hopefully punitive is maxed out. On the other hand, that leaves more money for every other person Alex has hosed with and all sorts of poo poo is going to come crawling out of the woodwork.

Well I’m sad my pessimistic guess was wrong. Hopefully Bankston is right about a higher cap than the thread’s consensus, but I’m setting expectations low again. I hope something comes out of the phone drop but otoh if I were a conspiracy theorist I’d try to keep the incriminating poo poo off my phone. But then again it’s Alex Jones so lol hopefully not. But it could be like 99% pictures of puppies and dumb memes.

Only 10 out of the 12 needed to agree (and that 10 had to agree on everything) so if 10 people wanted a low amount 2 who wanted higher could just not sign the judgment. But it goes the other way too so who knows.

I don’t know where Mark is getting 10x. The court will reduce them to the statutory cap, which is $750k because there are only non-economic damages.

Not really “punitive” if he pays it out of pocket change and makes it all back next week in boner pill sales, is it?

Texas civil remedies code is pretty clear. Mark may have misspoke and meant to say two times not ten times, but even then it's only 2x economic damages, and the damages awarded in this case are, per the code, non-economic damages. I've found TX supreme court precedent on a defamation case from 2020 that supports this argument when I was looking on my phone earlier. Granted that was business defamation and the court overruled for different reasons, they acknowledge the caps in a footnote citing the civil remedies code I'm using. edit: both of these cases support the caps I'm talking about : https://www.txcourts.gov/media/1437042/150056.pdf https://www.txcourts.gov/media/1448050/181211.pdf Mr. Nice! fucked around with this message at 23:51 on Aug 4, 2022 |

StrangersInTheNight posted:I'm reserving my judgement for the punitive damages This is what Reynal argued and convinced the jury to set such low damages. It’s not true but your post shows how the insurance agencies have tainted future jury pools. You are talking about economic damages which are compensatory but so are non-economic damages. Pain and suffering is compensatory.
