I honestly don't get why people say Marbury. The Constitution as written has zero checks on any passed law even if it literally says "do X, and yes we are aware that the Constitution says you can't do X", like yeah sure it's old and garbage and we know that now but like, "judicial review or something like it" is a thing a system will need somewhere just to make sure that we don't get poo poo like the Fugitive Slave Laws

I think it's a way of criticizing the judicial system without going the extra step of saying abolish the Constitution or anything else that will get you marked as unserious by the legal profession. Or something an insane originalist would say because the Constitution NEVER SAID. . .
