I mean that’s all the GOP is anymore so it’s not surprising. They’re a party of the pretended aggrieved whose only purpose is to whine about their pretend grievances so they can continue to get elected by people who also pretend to be aggrieved and hold everything up so they can stomp their feet and cry about how they’ve been wronged. There’s nothing else, anything related to actual governance or just keeping a basic baseline function going doesn’t cross their minds

A single person has always been able to jam individual items forever without obstructing other business, that’s the procedural filibuster we all know and love. Doing it in a way that materially obstructs all other senate business makes all the other senators hate you. Plus now you have the actual military playing the national security card, even the most shitheaded republican theoretically wants to avoid that

It is a great example of how judiciary review is a made up concept that has no basis in the modern world. The best path forward is to outright reject rulings the ruling party dislikes.

It can still be appealed further by the parties in either case, but the higher court wouldn't have to take it.

Ahh, but if the 5th circuit rules for the ban, and the 2nd(?) circuit rules for the stay on withdrawal, then does that automatically get shunted up to the SC? Also, if the 5th declines to uphold a stay in the Texas until it makes a ruling, but the other court has a stay forcing the drug to remain on the market, does that also get fast tracked upwards?

SCOTUS doesn't even have to take a case if there's a circuit split, they're just more likely to do so in order to clear up the chaos. The only things they 100% have to take are original jurisdiction cases.FlamingLiberal posted:I feel like the feds need to start getting involved with this poo poo uh oh boy, that... might technically not be officially illegal but is definitely extraordinarily shady and people should be outed publicly for making this kind of threat.

This is an interesting court document to read: https://storage.courtlistener.com/recap/gov.uscourts.dcd.241009/gov.uscourts.dcd.241009.734.0_1.pdf quote:The United States has torturously avoided disclosing the full scale of undercover CHSs among the Proud Boys on Jan. 6. Government FBI agent So FBI, DC Metro Police, and “Homeland Security Investigations” had over 40 informants & agents within the Proud Boys and other January 6 protestors. What’s the point of these undercover guys if they’re not going to stop it? Were these government agents organizing and planning this protest? At least five FBI under covers — and defense attorneys claimed 12 — were involved in the Gov Whitmer kidnapping case. At least they managed to stop that one

It's absolutely the duty of an undercover informant or agent to pass the information along, sound the alarm bells, request backup. So for me the question isn't "why didn't they stop it", but instead "did the undercover informants pass the information to their agencies?" If not, WHY not? If so, what did the agencies do with that information?
