If they're going to charge him with aiding and abetting seditionists, then technically he would be ineligible to run under the 14th amendment, but I don't think Jack Smith would pull those charges unless he's positive he's got an iron clad case on it.

There are serious first amendment implications for charging Donnie with the J6 poo poo, simply because of a bazillion protections on political speech.

But he is and was dumb enough to probably overcome a lot of those concerns at the DOJ. They've got testimony from governors, insiders, and advisors probably detailing every drat he did on/around J6. DOJ probably won't even need to approach the first amendment stuff like his speeches.

And he has bad lawyers, or those are bad lawyers leaking. He loves having competing teams on everything.

Similarly: Judge rejects Trump's request to move Stormy Daniels hush-money case into federal court

quote:

A federal judge in New York has rejected former President Donald Trump's request to move his hush-money criminal case into federal court.

"Trump has failed to show that the conduct charged by the Indictment is for or relating to any act performed by or for the President under color of the official acts of a President," Judge Alvin Hellerstein wrote in his ruling Wednesday.

Trump has pleaded not guilty to a 34-count indictment charging him with falsifying business records in connection with a hush money payment made to adult film actress Stormy Daniels days before the 2016 presidential election.

He had argued the case belonged in federal court because Trump reimbursed his then-attorney, Michael Cohen, who made the payment to Daniels, while Trump was in the White House.

Manhattan District Attorney Alvin Bragg had argued that the hush payment had nothing to do with Trump's presidential duties.

"We are very pleased with the federal court's decision and look forward to proceeding in New York State Supreme Court," said a spokesperson for Bragg following Wednesday's ruling.

Trump had argued that arranging the hush payment was an official act, and that his "decision to separate his personal business from his public duties" was "rooted in constitutional concerns."

The judge wholly rejected the theory.

"The evidence overwhelmingly suggests that the matter was a purely a personal item of the President -- a cover-up of an embarrassing event. Hush money paid to an adult film star is not related to a President's official acts. It does not reflect in any way the color of the President's official duties," Judge Hellerstein wrote.

Hellerstein also endorsed the Manhattan district attorney's theory of the case that elevated the falsification of business records to felonies because, prosecutors said, Trump allegedly falsified the records in furtherance of another crime.

"Trump can be convicted of a felony even if he did not commit any crime beyond the falsification, so long as he intended to do so or to conceal such a crime," Hellerstein said.

Apparently the Guardian has some leaks out of the Georgia DA, so we might sorta kinda know what the idea would be behind charging Donnie:

https://twitter.com/hugolowell/status/1682367307807444992?t=hvBuL31Cx9w0FEU04gfPOg&s=19

In Georgia, a racketeering charge apparently needs two "qualifying" crimes attached and they don't necessarily need to be chargeable crimes (unlike federal racketeering). Solicitation / Coercion can be predicate acts.

So for the first crime, there's Donnie dead to rights on coersion, with the Perfect Call with the GA Secretary of State about finding 11,780 votes. For the second crime, Sidney Powell and her merry band of chucklefucks did computer trespass - they broke into Coffee County Dominion voting machines, copied their data, and uploaded it for the election denier chucklefucks to mess with.

Somewhere, Popehat is breaking into a sweat because sometimes, it may be RICO :v:

Government wanted December, which neutral observers said would be hyperquick for typical federal trials. Donnie wanted post-election, which is a stretch, but a stretch most competent lawyers could usually stall to. Cannon decided to shove it in the tail-end of primary season when Donnie's likely the Republican nominee. We'll see if Donnie's lawyers can delay things further.

I know this is more of the fault of a completely dysfunctional GOP being unable to decide whether it wants naked authoritarianism or just barely thinly obscured authoritarianism as the value of its presidential nominee, but it does make me nervous in kind of a post-normal times way that there's a non-zero chance that their prospective nominee (who commands a significant following of armed and paranoid individuals) could be convicted of a very serious crime right during the election period. This is the type of stuff that the State Department would be issuing statements calling on all political factions to respect the judicial process and to avoid violence were it happening somewhere in South America or Africa.

How does suing them because they're not selling land work, exactly? Someone can't walk up to you and go "I'm buying this thing of yours for $xxxxxxx and there's nothing you can do about it". Frivolous bullying and just hoping they roll over?

Reminds me of that whole 76ers / Color Star thing, where the 76ers (iirc) partnered with some company nobody knew anything about, making something nobody could identify, with inaccurate/missing/outright fabricated contact details and a loving 3D avatar generator as a CEO headshot on LinkedIn.

They claim all the farmers are colluding together to unnaturally raise the prices of the land to "unreasonable" levels and then they also sue them for lost profits. "If you had sold me land at the low price I wanted to pay, I could have resold or exploited it at a profit but since you wouldn't sell I didn't get to make that money - therefore you owe me that lost profit as damage"."
