I just want to quote this snippet of pure bitterness which comes out of nowhere because lol

quote:

Second, the reasonable viewer, unlike when Sullivan, Butts or Gertz were decided, no longer takes the time to research and verify reporting that often is not, in fact, news. As an example, only one month ago, the United States Supreme Court issued a well written 237-page joint opinion with vastly divergent views in two cases known widely as the Affirmative Action decisions.5 Within minutes of the release of the opinion, the free press had reported just what the opinion supposedly said and meant although it was clearly impossible that the reporter had read the opinion. And of course, those initial news articles were repeatedly shared, commented upon and disseminated over social media and still to this day the reasonable viewer very likely hasn’t read the opinion and never will. This is the news model of today.

Ah yes, the “you’ve taken me out of context” defence. Worked great for Alex Jones when he insisted you needed to watch hundreds of hours of Infowar footage in order to fully comprehend the footage of him dismissing Sandy Hook parents as actors.

Knowing Trump, it could very well just be that he wants to be able to call up his lawyer and talk about things whenever he wants, even if it's just random toilet thoughts at 2am. Having to make an appointment with his lawyer to go to a specialized facility to talk about the classified evidence seems like just the sort of thing that would get on his nerves in the first place.

Not entirely out of nowhere, the judge is a federalist society hack appointed to his prior gavel by Rick Scott and this one by Trump. He also deeply loathes Sullivan

quote:

Trump asks the Court to reconsider New York Times Co. v. Sullivan. See Complaint (DE [1] ¶ 47, n.41). The Court is unable to do that; the case is legally binding on this Court. This Court has previously written and quoted Judge Laurence Silberman that the Sullivan case has no basis in and “no relation to the text, history or structure of the Constitution, and it baldly constitutionalized an area of law refined over centuries of common law adjudication.” Tah v. Global Witness Publishing, Inc., 991 F.3d 231, 251 (D.C. Cir. 2021) (Silberman, J. dissenting). But any disagreement based on textualism is effectively moot for this lower Court once the Supreme Court has spoken.

I think it's actually much worse, though T may not have actually had this motive: "See they said I could have the documents!"

There may be a legal distinction for approved handling of scif-exported classified documents, but the general public is only going to hear endless noise from T that he did nothing different, "just having them outside a scif is no problem see! but they're charging me for that! witch hunt! Biden's weren't declassified or approved, prison!". It would set up an apparent legal contradiction.

He's basically asking for all the possession charges to be effectively dropped via a slippery slope argument, which plays well for his "optics" in Tsocial posts.

The law is you handle classified material as per the regulations for handling classified material.

How can a judge set aside the law without entirely invalidating it? Either it’s lawful and enforceable or it isn’t. “Well, right now, because I feel like it, I’m going to set this law aside and ignore any damage caused by it as just the cost of business. You are free to break the law for a couple years because I said so, so judged.” *bangs gavel*

Like, what? How is this a question?

If security classifications and punishments for violations aren’t legal, which is what cannon would have to rule here, then that’s going to be a big loving problem.

Did he have any guest speakers that day? If so, I’d give good odds that they are 35k out of pocket on the opportunity.

Edit: any political message on these events is entirely secondary to their value as income generation. I 100% expect that Trump will cancel at the last minute and stiff everyone involved if he’s not going to get some minimum level of guaranteed payment.

IANAL, but somehow I don't think the case relies on Nauta and De Oliveira taking a fall and going to jail for Trump. Just curious: how long do federal trials take? Weeks? Months? That is, could the documents trial still be ongoing during the November election? I realize all the caveats about "this has never happened before" apply.
