Can someone explain to me what specific Biden policies border hawks claim is causing "the border crisis"? I don't mean cynically or sarcastically, I just don't know 1) what they mean by border crisis, 2) what changed to cause a border crisis, and 3)what they want to do to "fix it". Normally I'd just assume they were lying about it but Democrats are also pretty universal on acknowledging a border crisis, or at least "the situation on the border is bad". Are the parties agreeing that the same things are bad or bad for different reasons?

Trump's anti-immigration policies didn't stop people from immigrating to the US, but they did slow the process and lead to a bunch of people waiting near the border for waiting lists to move along and restrictions to lift. Meanwhile, he generally hampered the federal bureaucracy's capacity for moving people through properly. On top of that, COVID and various other economic, political, and environmental issues hit South America and caused a general increase in immigration.

All this led to a massive immigration backlog, with tons of people waiting for an opportunity to come through (or just coming illegally instead). The Biden administration has been loosening up the restrictions and trying to let people in, but the immigration bureaucracy and infrastructure has simply not been able to keep up with it, while illegal immigration continues to rise.

There's some legitimate problems the administration is struggling to deal with there, but the GOP are mostly just using it as an excuse to push the immigration policies they already held.

Basically, the Republicans have hosed up the immigration process enough that everyone agrees there is a "crisis" and the democrats appear to have largely bought into right wing framing.

In actuality immigration is an opportunity not a problem but, here we are

To be fair, the Republicans are proposing pretty bad "solutions" to the problem, but there is one thing that everyone sort of recognizes is a problem that they are harping on.

It's similar to what happened with disability in 2009-2010. In some places, particularly in Appalachia and poorer areas, after the financial collapse in 2008 some places had ~25% of the single working-age adult population suddenly become "disabled" over a year or two.

25% of the population didn't suddenly break their back, but disability was the de facto only long-term income program after unemployment ran out. The lack of other options drove a ton of people to apply for disability. The result of so many people doing that is disability massively cracked down and basically implemented a policy of automatically denying the first attempt to apply for disability from anyone who isn't paralyzed or missing a limb. The assumption is that people who are really disabled will appeal and provide the documentation, whereas people trying to get it as an income replacement would give up. The net result is that lots of people who might qualify for disability, but are edge cases or not obvious, will get denied initially and have to go through a long process to get approved.

It's a similar situation with asylum. Legal methods for immigrating to the U.S. for economic reasons have dramatically shrunk since 1987. It even further massively shrunk after covid and Trump. That means that the only realistic options for getting to stay in the U.S. for economic reasons are to sneak in illegally or to claim asylum. So lots more people are claiming asylum, but "my quality of life would dramatically improve" is not a valid asylum reason.

Now, similar to disability, they are trying to massively crack down on those people who see it as their only legal option for economic advancement or security. They can do that, but it is also having the effect of making legitimate asylum cases or edge cases suffer by making it massively more difficult to legitimately apply for it.

They keep trying to open up legal avenues for more immigration, but every attempt since 1987 has failed. Nobody can really nail down what they want a legal increase to look like that can become law. The result is that everyone else is just trying to use the last remaining avenue where they can legally stay in the U.S. Shooting your shot has no downside, but it creates a huge backlog and the response from the U.S. has been to just mass disqualify non-obvious cases to try and solve the backlog.

The only Biden administration action I'm aware of that could possibly be criticized as "open borders" was ending the Trump-implemented Title 42 automatic ejections, which were only supposed to be in effect to reduce the spread of Covid.

That's what I thought but the rhetoric down here is that Biden is, on purpose, letting all immigrants in for malicious reasons. So I was wondering what they were pretending was the problem, if it's just the end of Title 42 then I must lol.

Comments and questions during oral arguments don't necessarily mean anything with relation to their final decision, but Gorsuch and Roberts both seemed to be in favor of the constitutionality of gun control laws that prevent "dangerous" people from having access to firearms, but explicitly went out of their way to say that "irresponsible" is not the same as dangerous.

That seems to point towards upholding the ban on domestic abusers possessing firearms, but loosening or eliminating the ability to restrict other types of people from owning guns before they are convicted of a crime.

Some of the conservative justices were mad at Kentaji Brown Jackson because they were arguing that gun control laws had to have an "historical or traditional" basis for what they would have intended to be allowed when the bill of rights was drafted and she responded by talking about laws banning slaves from owning guns and the conservative justices thought it was unfair to bring that up.

quote:

Justice Ketanji Brown Jackson repeatedly raised the issue of bans on slaves owning guns and she accused both sides in the case of dismissing the relevance of those categorical bans.

quote:

Several of the conservatives Justices complained that she was bringing up irrelevant issues to the question at hand.

“We’re not talking about the history and tradition of all the people, but some of the people,” she said. “I’m a little troubled by having a history and traditions test that also requires some sort of culling of the history so that only certain people’s history counts.”

Just a heads up that we're still about about 2 hours and 40 minutes away from polls closing in VA. Results will start coming in pretty quick, but it'll probably be like noon tomorrow before we have a solid picture of who is in control. With that said, Virginia also very recently decided control of the House of Delegates by drawing a name out of a hat, so maybe not. In any case, I look forward to :f5:ing with you. I can post some sites later for following vote counts when we get closer.

I'm interested in the Richmond centric issue about the casino proposal, I'm not in a district that votes on it though. It's frustrating because the proposal was rejected a year or two ago already, but they came back with basically the same proposal and a huge media push.

I voted early this year, but I live right next to a polling place and have been keeping an eye on traffic to and from throughout the day. Purely anecdotal, but it does seem a bit less active than in years past. I'm nervous about the outcome because of the possibility of the looming abortion ban.

Yeah mine wasn't too active either but we just have two generic Democrats running unopposed plus a casino referendum. If anything it's about the same as last year when we also just had one Dem running unopposed. There are so many counties with either Republicans or Democrats running unopposed that you have to pinpoint down to the district level to find the actual competitive races.

Not quite doomscrolling but CNN reported a little tidbit from their exit polling that 6 in 10 voters favored legal abortion. https://www.cnn.com/2023/11/07/politics/exit-polls-election-2023/index.html

At first I thought that would violate the laws about reporting exit polls early but I realized that they are probably doing some "I'm not touching you" stuff where the issue on the ballot is about enshrining that in the constitution so technically a different question.

Polls close in VA in 10 minutes. As promised, here are some resources you may find useful in tracking election results:

Virginia State Board of Elections - Official Results

VPAP - This site is particularly good, because it offers an option to view election results by the most competitive races that are likely to decide control of both houses of the state legislature. Unless something really weird happens, control of both houses will come down to the seats identified by the "featured races only" filter. This site has also historically updated their results very quickly as districts release their data.

In terms of when to expect results, here's a note from the AP:

AP posted:

HOW LONG DOES VOTE COUNTING USUALLY TAKE?

In the 2022 congressional midterm general election, the AP first reported results in 10 of 11 congressional districts between 7:09 p.m. and 7:30 p.m. ET. In the 11th congressional district, the first votes were reported at 8:31 p.m. ET. By noon the day after Election Day, 98% of the vote across all congressional districts had been counted.

https://apnews.com/article/virginia-election-state-legislature-what-to-watch-f5901d85cec6081d6c0409321a908d63

I'll keep an eye out for any interesting streams I find.

Really hoping I wake up tomorrow in a state where abortion will remain legal through the next legislative cycle, at least.
