I'm 50/50 on whether I would call it theft. It certainly wasn't removed so it could be used, but if someone takes your bike and throws it into a river I'd still say it was stolen.

I think you're conflating *committing* and *being guilty of the crime of* theft. In terms of destruction of property, if I contract a company to destroy my neighbor's fence, they are the ones who destroyed it but I am the one guilty of a crime. So long as I sufficiently misrepresented the situation and they had a genuine belief that I was truthful the contractor is scot-free.

I guess you could blame them a little for not looking at all into whether the person contracting them actually owned the property but it's not like any contractor I've worked with has asked me to prove I own the house. Like instinctually I would say "how can you steal a driveway" but if it was a bike or whatever that was destroyed (even if the person who did it was tricked into it) I'd probably still say it was stolen.
