The regulations update also enhances protections for students, employees, and applicants against discrimination "based on pregnancy, childbirth, termination of pregnancy, lactation, related medical conditions, or recovery from these conditions."


Schools will be required to train employees "about the school’s obligation to address sex discrimination, as well as employees’ obligations to notify or provide contact information for the Title IX Coordinator" and strengthen requirements for schools conducting "reliable and impartial" investigations of all complaints.

I could be wrong, but I believe the new hearing is for new gag order violations he's racked up since the ones discussed at the prior hearing, so Merchan can rule on those before, during, or after the new hearing.

Trump's argument is absolute immunity, and they are not going to rule that at all.

They could rule that there is immunity for official acts and kick it back down to a lower court to define if inciting an insurrection counts as an official act.

Either way, I don't expect a ruling anytime soon so the trial will likely have to wait until after the election

They have, like, eight different options on how to rule on the appeal. Trump wants absolute immunity from all crimes related to all current and past actions in any way tied to the presidency. They are, 100%, not going to vote for that. They might say "Immunity for core official acts, prosecution bears the burden to prove that any acts related to the presidency are not core official acts," which frankly would be very reasonable.

Probably not.

Thomas is skeptical that there is constitutional support for Trump's argument. The constitution is silent on presidential immunity because they deliberately did not want the president to be immune to criminal law. It is not silent on immunity for other parties - just the president. He is not a vote to say that the president has absolute immunity but might be a vote that there needs to be a determination of official vs unofficial acts.

Roberts seems skeptical of all of Trump's arguments.

Alito wants to kiss and hug Seal Team Six and would say that Trump (the ultimate cop) can do no wrong ever. Sotomayor twice called him a dumbass today.

Kavanaugh is cop lover #2 and will never say a republican did a bad thing.

Gorsuch wants a bright line so they can write an opinion that can be used going forward. He said plenty of times things that indicated that he knows this case will not get immunity, but he wants to figure out how to set up future precedent.

Barrett seemed skeptical of 100% of Trump's poo poo and was grilling his lawyer in Tandem with Sotomayor.

Kagan, Sotoymayor, and Jackson are all ruling against Trump.

Based on the overall questioning today, I could see Trump losing anywhere from 8-1 to 5-4. He does no have five justices saying that he's got immunity. There may be some quibbling over where lines get drawn, but every single justice except Alito took at least small time in their questioning to dunk on Trump's lawyer. Alito tried to lob up softballs and got called stupid for it each time.

There could be further delay from the SCOTUS, but they aren't ruling in Trumps favor on either of his core two arguments. He does not have absolute immunity, and he doesn't have to be impeached and convicted first to be prosecuted.

This could potentially affect federal funding for higher education in these states too, as well as federal student loan eligibility, sports funding, etc. Hell's the limit for how deep this funding hole could get.
