Scalia, Alito, and Roberts are very grumpy about it saying passports are not recognition and Thomas has his own concurring in part opinion which goes into Thomas legal theory land.

If a US citizen was born in Jerusalem, and the US doesn't recognize Jersulaem Israel, what does go on the passport then?

John Roberts seems like someone that hates doing his actual job and would rather the legislature do it for him because lazyness or something

Its been a while since I read the Constitution, but isn't the death penalty explicitly authorized wrt treason? Could the DP actually be ruled unconstitutional despite that?

  • Create a framework where states that allow acts, substances, behaviors, commerce and speech can be compelled to ban said activity if other states nearby can provide any evidence of a loosely defined "negative" impact.
  • Create a framework where persons able to show significant ($1+ per person) "negative" economic impacts can block the implementation of any restrictions, requirements or bans on activities essential to their economic activities.

Sorta, the idea is that it is the no federal laws that do something the states don't want. So no NLRB, no EPA, no Civil Rights as our dear Comrade pointed out, no FDA, etc.

The idea is that the next clause forces states to criminalize weed etc because the neighboring states can claim harms.

The clause after that prevents states from regulating businesses and preventing states from using the previous clause to regulate industry.

gotcha

that's terrifying

Williams v Pennsylvania is a fun case. Prosecutor is found to have brady violations that resulted in a death penalty sentence for a dude. Said prosecutor is now chief justice on the state supreme court and declared that the brady violations didn't matter, refused to recuse himself, and struck down the dudes challenge. Thankfully, the SCOTUS squashed that poo poo and said the dude deserves a fair hearing. John Roberts feels that since it was 30 years ago, the guy is obviously fair and impartial and the court is being crazy. This case may have gone the other way if Scalia was alive.

Said chief justice resigned two weeks after denying the guy his relief.
