John Roberts seems like someone that hates doing his actual job and would rather the legislature do it for him because lazyness or something Its been a while since I read the Constitution, but isn't the death penalty explicitly authorized wrt treason? Could the DP actually be ruled unconstitutional despite that?

Mr. Nice! posted:Williams v Pennsylvania is a fun case. Prosecutor is found to have brady violations that resulted in a death penalty sentence for a dude. Said prosecutor is now chief justice on the state supreme court and declared that the brady violations didn't matter, refused to recuse himself, and struck down the dudes challenge. Thankfully, the SCOTUS squashed that poo poo and said the dude deserves a fair hearing. John Roberts feels that since it was 30 years ago, the guy is obviously fair and impartial and the court is being crazy. This case may have gone the other way if Scalia was alive. Lol get hosed Castille Too bad you retired

But SCOTUS is hearing a different Apple/Samsung patent troll case this term. No matter how SCOTUS rules in their case, is it likely they would hear this one as well?
