I'm fairly confident that this is not the case, and that if you're not a minor or a commercial driver, it is perfectly legal to drive at less than .08% BAC.

The idea of bail is that it should be set at an amount that the person in jail would be able to pay but unwilling to leave behind, as a means of ensuring that they show up for trial. Quiet collusion with the bail bond industry tends to result in unreasonable bail amounts being set for poorer people, though.
