I'm not an expert but my guess is if the defense made contact before the snap and was called for encroachment then it would count. But the more likely scenario would be that the Patriots would just been drawn offsides and then the Colts would have immediately been flagged for illegal formation. So essentially the only way IMO that play would have worked to the Colts advantage is if the Patriots just randomly lost their balance and fell on top of a Colts player.

I posted in the thread, but I'm pretty sure they weren't supposed to snap the ball ever. You have a play like that in the bag to make your opponent burn a timeout. You shift to something wacky, the other team panics and burns a timeout, then you punt. Worst comes to worst, they don't panic, you take a delay of game then punt from 5 yards further back. I have no idea why he snapped the ball
