What exactly was the first stage of the proceedings that Vardy won? Something akin to a motion to dismiss or a motion for summary judgment by Rooney? I'm curious what Vardy thought she might get from bringing this suit since, even if Rooney can't prove that she was right about her particular incident with Vardy, the exhibits all seem to be showing her to be a relentless gossip and leaker. Considering whats already out there in this trial, I would love to know how incriminating the evidence was on the phone they dropped into the sea. Its genuinely baffling that this case is even being heard at the high court. Even if Vardy was pushing it through against all advice, you would think someone would call a halt to this farce before it got so far.

Not having the time to look at the exact causes of allegations and defenses, is there some way Vardy can still prevail by somehow successfully blaming it all on her agent going rogue? Is there a jury in this trial or does the UK not do that? It's a pretty emotional situation so I'm sure no one here is a completely rational actor at this point.

The initial motion that Vardy won is that "It's..... Rebekah Vardy's" account implied it was her leaking it Vs someone with access to her account so she could still win by claiming it was her agent acting alone. The messages are out there where she has a pattern of feeding stories to that agent and asking for them to be leaked are pretty loving damning so god knows what got hoofed into the North sea and the other pile that got encrypted by a bumbling computer expert who then lost the password.

Vardy’s going to claim she was damaged by the meaning of ‘…it was Rebecca Vardy’s account’ being her specifically, which is what the judge has found to be the case. Rooney needs to be able to prove on the balance of probabilities to the judge that it was Vardy, specifically. Seems like Vardy wants the pyrrhic victory of proving how smart she was for having her agent do all her dodgy deals. She could win damages on the legal side and ruin her reputation at the same time.
