Weinstein's not going anywhere though, as he still has a 16-year California conviction, so it's very dumb, but harmless.

This is always a weird line of questioning because killing people based on political disagreements is one of the things we unquestionably give presidents immunity for. How many tens of millions of people did the US help murder because of "communism" or "pan-islamism" since every president starting with Eisenhower?

But naturally, the Republicans are likely to punt the whole thing back down to the district court again to make "official act" analysis which would basically guarantee J6 doesn't go to trial before election day when Donnie reappeals that junk.

Still, things might stumble along for a generation or two if things don't fall apart right away.

And now they're yelling about the one insurrectionist that did get domed and pushing all the injured/killed cops under the rug.

The cops were on their side until badges started getting squished in doors and half of the other people in the Capitol that day were supporters of the coup attempt.

Well the constitution doesn't apply "Over there" so there are a lot of legal distinctions that exist in those circumstances. But generally yes the President has and will continue to kill certain classes of foreign political opponents as part of their job.

There was only one possible ray of light here:

quote:

In response to questions from Justice Barrett, Trump lawyer John Sauer agreed the following were private acts:

• Petitioner turned to a private attorney who was willing to spread knowingly false claims of election fraud to spearhead his challenges to the election results.

• Petitioner conspired with another private attorney who caused the filing in court of a verification signed by Petitioner that contain false allegations to support a challenge.

• Three private actors, two attorneys, including those mentioned above, and political consultants helped implement a plan to submit fraudulent fleets of presidential electors to obstruct the certification proceeding.

Or in a talking head viewpoint: https://twitter.com/MSNBC/status/1783540106952913239

So in the non-hellworld, the justices make up some dumb poo poo to delay things: presidential official act immunity. That delays things a bit, but doesn't kill off the prosecution, as everyone seems to agree it's mostly about private acts. The official acts get covered in a jury instruction or weird bit. But way more likely they kick it down in a way that gives donnie's explicit wriggling instructions.

Universe: "Hold my beer."

Alternatively, that's the entire point of fascist approach to governance. In-group the law protects but does not bind, out-group the law binds but does not protect. I don't expect it to happen yet from this court. My bet is they take the coward's way out and punt it until after the election so they don't have to put their names on it either way, but the mindset is there and growing in strength in the country.

Technically a "court" has to approve those assassinations. No, you can't see their notes or decisions this century, and they never* actually deny murder requests. Stop asking for details or transparency.
