one reason we have anti-discrimination laws is that rational actors might be tempted to discriminate. if you operated some kind of business in the old south, it would be rational (but a dickbag move) not to hire blacks because it would be a competitive disadvantage. it benefits your racist rear end individually, but makes society worse off
