Somewhere between unethical and comical, depending on exactly what you put up on Kickstarter. If you make an obviously fake campaign and it goes through, or if you fail to deliver thousands of potato salad based haikus, I'm not too offended.

The way it's set up is pretty clear: you are making a donation for a project that hopefully goes through; if it doesn't make it despite getting all funding, the creator isn't responsible to pay you back - because you're not paying for goods and services. You're making a donation.

Pretty sure committing fraud is still just as illegal if you're using Kickstarter or a similar platform. The only case I can recall of someone being sued was a guy who wasn't smart enough to incorporate and do the KS and everything else through that entity. Had they done so I imagine they'd have been just as immune as anyone else when their thing failed and the money ran out.

Nothing stops you from taking the money, making an attempt, and failing though.

From the Kickstarter Gaming thread, apparently the Yogscast game ("Yogventures!") project has failed.

In a way, this was somewhat inevitable; Yogscast is basically a pair of "we're funny because we're incompetent and ham it up when we fail" LPers on Youtube. So, you can't be too surprised that their game bombed as well. However, it actually ended up being incompetence-once-removed; Yogscast outsourced the production of their videogame to a third-party developer, and that dev ended up being a six-man studio, with half of the team working day jobs to keep themselves fed. Of course, a six-man part-time team wasn't exactly ready to crank out a voxel-landscape Minecraft clone with a full quest system and scripting/API system. They imploded almost exactly on the two year mark, after producing a few beta builds.

The dev company is shutting down (and will likely file for bankruptcy); Yogscast has been given all art assets and code produced so far. Apparently, their solution has to been to hook up with another Kickstarter, a horrible MMORPG attempt called TUG, and port over some of the Yogventures ideas/content into the TUG engine. All backers are being given TUG Steam keys as a consolation gift.

It was literally billing itself as "the game you always wanted." Not even Star Citizen was that brazen.

That said: If you look at the Minecraft community today, it's basically become: Use miles of spaghetti redstone wiring and commandblocks and scripting and server plugins to convert a survival game into RPG Maker. Apparently, the early betas of Yog that came out were basically a Minecraft analogue with smaller voxel-based worlds, heavy scriptability, and a pile of preformed buildings/content to drop into it -- and that could sell, as much as I hate to admit it.

It's definitely not going to be finished by a six-man team of part-timers, though.

That's the case I was referring to. He did everything directly therefore he was personally responsible. Had everything been done via an LLC with him just acting as an employee he may have been able to walk away by having the company go bankrupt. From the article:

Based on the Current Releases review, the Vampire Academy movie is basically a more contemporary Buffy The Vampire Slayer. It's kind of a shame it didn't do so well since it was from the people who made Heathers and Mean Girls, and the review also said that the movie was watchable just for how positive it was about things.

I think Minecraft even got updated with a lot more features and tweaks during the Yogcast game Kickstarter.

That's kinda what Everquest Next Landmark is doing (for millions of dollars)

Yeah a six-man team needs to be really careful making a proper 3D game even if they keep the design simple. With poo poo like "open world multiplayer" you're hosed, unless its just one big walking chatroom.

Because it does seem like you can just make up a convincing sob story and get $1000 for it.
The general legal thing seems to be "buyer beware" with the fact that you can sue in court if someone didn't deliver on their services. This rarely happens as most people tend to pay in such small amounts that it's not really worth going to court over $10. Indiegogo is pretty much the snake-oil capital as it has the flexible funding option where even if you do fail to get it up, you get any cash obtained and can sort of write it off in the process.
