Whole thing passed the House, they also did a short-term 2 day CR to give the Senate time to consider the whole cromnibus.

I'm lolling pretty hard over the fact that Boehner almost didn't even get the thing to the floor for a vote, only happened because one GOP Rep changed his vote from nay to yea when they were voting on the rule.

What I'm confused about is the fact that they guy who changed his vote is on his way out, he lost his primary. So it's not like Boehner could promise him some plum committee position in the next Congress, I wonder what he offered to get him to change his vote.

I doubt it. Even if they dropped the physical standard to "as long as you fit reasonably well in the uniform", there's plenty of fat gently caress firefighters around here that still wouldn't pass, and no one has sued their fat asses (that I know of).

Eh, why not go all the way and use the powers annexed by the executive the way they have always been used historically; nuke the senate and declare yourself king.

Under the bad rationales for why the president can kill peeps (and that's really the issue here, not that america can do stuff unilaterally but that the president can)

-We can kill bad guys who threaten national security if we can't get to them by other means
-We can kill them even if they are citizens
-We can kill them even if they are in the US, if the threat is imminent enough (global/universal nature of the gwot)
-The president gets to decide who is a "threat" to national security and what is considered "imminent", with essentially no oversight.

Yea but all firefighters had to have that standard of fitness at one point and they're technically supposed to keep up with it even if some dont. This is a whole other animal.

I agree if Yemen is a theater of combat, he was fair game. I am not so sure Yemen was under international law (for us anyway), and I am concerned that Johnson's memo has a lot in it that would suggest either a very loosy goosy definition of "theater of combat" at best or "theater of combat doesn't even matter" at worst. I really don't care Al-Anwaki is dead and I don't doubt he was involved in way more than just propaganda (which if it were *just* writing Inspire magazine, that would also raise some first amendment issues...but I don't buy that this is all he was doing. It wasn't.) but the rationale leaves the door open for some pretty scary future application.

And Johnson does a lot of double speak. How he sells it to law schools (blah blah blah international law blah blah blah failed states blah blah blah civilians participating in hostilities) is a lot different than how he sold it at the JSOC legal course, which is a lot closer to the true text of the justifications. I think he misread his audience and thought "these are all Spec War types...they'll love killing people" so he let a little of the PC guard down and was a lot more "honest" than he was at say, Yale. "These guys are just bad people and the rest of the world is too incompetent to do anything about it, so we have the right to take care of it ourselves. And letting the public know how we make those decisions would be bad. They just wouldn't understand how important our job is. 'Murica. :patriot:" (Which is why the Obama administration will really not be able to do anythign about the CIA torture poo poo, as their thought process has been identical on the drones issue and other NSA poo poo...a fact which Fox news is literally jizzing itself over) What he failed to take into consideration is that, sure, we all generally like the concept of dead terrorists, but we also all generally liked our respective generals, admirals, commodores etc. and didn't want to see them declared war criminals, plus...you know...lawyers, so critical thinking and views on the constitution didn't go out the window.

And he's an rear end in a top hat.
