Shorting has its purpose in lowering the value of an over-inflated stock, theoretically stopping speculative bubbles before they can form. It just gets press for all the other schemes people use it for, including stuff like "naked short selling."

The downside of course is that price manipulation becomes a lot easier. There are regulations against day traders short selling but I don't remember what they are beyond needing a certain amount in your account, margin trading can't be under 25%, and regulations say if you do it too often they'll do a margin call on you and ban you from trading for 90 days if you can't deposit enough cash to cover the margin, since the potential losses on a short sale are infinite.

Mr Interweb posted:Ugh. I was watching my local channel 7 news and they ran a segment that was indistinguishable from something you'd see on Fox. This "congressional reporter" got a hold of some stupid report by a Republican who found $100 billion in "government waste" and said she wasn't able to find a single person who could defend the things in it (you know, the typical high-lariously useless sounding projects that conservatives love to tout like $5 million on mating habits of fruit flies and such). It was so Fox News-y that they even had lovely stock music playing in the background signifying how shady and wasteful the government is. The "reporter" ends the segment by saying that the "American people shouldn't expect answers any time soon". I know you aren't the one asking the question, but if you know how fruit flies mate you might be able to figure out a way to interupt them and therefore reduce their populations and spoilage. So $5 million in scientific research may save billions over the years in lost production.

He doesn't have a patent. The drug is generic just nobody else bothered to go through the approval process to make it because the return just wasn't there for a specialty drug at $14 a pill. Even at the current $750 per other companies probably still won't try to get approval both because Mr Douchebro changed the distribution so it is harder to get the drug to do bioequivalence testing (which is one of the reasons he is under investigation) and because he can wait for them to do all the work and then crater the price to drive them out of the market. Fun little side note since you brought up patents: pharmaceutical companies area freaking out at the moment because hedge funds have started doing a rather nasty thing to make money at their expense. The hedge funds short the stock and then file challenges to critical patents the company has using a newly instituted review process at the Patent Office. The stock dips and they make money, and stand to make even more if the patent gets invalidated because some pharmaceutical companies basically only exist due to one or two drugs. But the pharmaceutical industry has largely hosed itself by being greedy and burning any political capital in favor of stuff like tax inversions and sky high near-term returns.
