The deal seems dumb to me because I don't believe in Bradford, but quarterbacks are expensive things. Brock Osweiler started 4 games in his career and looked mediocre as hell and someone is probably going to give him something ridiculous like 15 mill a year.

That Brady destroyed a cell phone -- the NFL said -- was pertinent to the investigation and grounds, Parker supposed, to take action beyond a mere fine for an equipment violation.

“Anyone within 100 yards of this case knew that the destroyed cell phone raised the stakes in a proceeding the commissioner convened and he was entitled to take that as an adverse inference,” Parker said to NFLPA attorney Jeffrey Kessler. “And Mr. Brady’s explanation made no sense whatsoever.”

The primary issue being appealed is whether or not Berman acted within his powers in vacating the decision made by Goodell as arbitrator during Brady’s appeal.

Berman overturned based on three reasons: The NFL’s failure to make league attorney Jeff Pash available for questioning; failure to share notes from interviews, and failure to notify Brady and players in general of the possible repercussions of what the NFLPA regarded as an equipment violation.

While Berman agreed, the judges on Thursday were more dubious that it was a simple equipment violation and that the “scheme” didn’t rise to the level of conduct detrimental. And they appeared to agree Goodell had a right to impose a suspension.

Chin said that “the evidence of ball tampering is persuasive . . . How do we second guess the arbitrator’s decision?”

While the judges did strongly challenge NFL attorney Paul Clement during the first portion of the proceedings, Thursday marked the first open-court setback for the NFLPA and Brady.

During the NFL’s oral argument, which came first, the judges asked attorney Paul Clement if the destruction of the cell phone caused Goodell to increase punishment on Brady. Their aim was to find if that was new evidence for which Brady should have been allowed to appeal.

But even that took a turn when Kessler got his turn.

“If we agree (that that was new evidence), then what do we do?” asked Chin. “Remand to the arbitrator to make the same decision?”

Katzmann distilled a point for Kessler,saying: “Your challenge is to show where in the CBA it says if you tamper with game balls and obstruct an investigation, you will only be fined.”

Kessler wasn’t convincing.

Toward the end of Kessler’s oral argument, he stated that Goodell manufactured the issue of cell-phone destruction being something of greater import because Goodell knew that being “generally aware” wasn’t sufficient to discipline Brady to that extent.

Parker raised an eyebrow and said, “What’s the motivation here?”

“He spent $3 million on an investigation" and wanted to justify the time and effort spent, was Kessler’s reply in essence.

“Are you suggesting he was out to get Mr. Brady?” asked Parker.

“He was out to protect [the investigation],” countered Kessler.

Kessler ratcheted up at that point and pointed out that it was “embarrassing for the league” because it knew it didn’t have the goods on Brady and didn’t understand the Ideal Gas Law.

With that Katzmann raised a hand as if to say, “No Ideal Gas Law here.”

Kessler exclaimed: “I sense you're being influenced by your view of the facts!”

“We are being influenced by your briefs,” said Parker.

Chin and Parker both seemed to believe the failure to share notes culled from some interviews conducted by the Wells Investigation was not a big issue.

Most the reason I care is because Pats fans are trying to rewrite history and pretend that the ball deflation—which totally isn't a big deal anyway—never actually happened and the ideal gas law destroyed Brady's phone and came up with some nicknames.
