The President has a lot of power over federal criminal policy, though that is a small minority of cases. President can also commute sentences, etc. I think whether she would appoint a sufficiently liberal justice on the death penalty (and other topics) is an open question as well. I know Bernie would go as hard-left as possible, and the Republicans basically owe us a Justice of our choice if we win in November.
