The President has a lot of power over federal criminal policy, though that is a small minority of cases. President can also commute sentences, etc. I think whether she would appoint a sufficiently liberal justice on the death penalty (and other topics) is an open question as well. I know Bernie would go as hard-left as possible, and the Republicans basically owe us a Justice of our choice if we win in November.

Nah this is the one time Sanders' version of a 'revolution' where you just pray the republicans realize they hosed up works. Republicans are getting REALLY pissed at a tied court now that they remember that the rung before SCOTUS skews left.

The biggest tell was Clinton owning Sanders on his own turf on the breaking up of the big banks. When Clinton mentioned living wills, it was clear she was paying attention this week. Sanders had a chance to clarify that NY interview but instead tripped and fell off a cliff.

The alternative is keeping up the charade like Romney/Rove^10 until the final hours and then getting crushed regardless. Maybe they still hope to get around the Trump/Cruz thing and pick Kasich or something, but even with a very lukewarm Hillary it's really tough to imagine good odds for the GOP.

i'd say wait until after the convention. there is always the shrinking chance that party unity will somehow prevail, and that they can actually start campaigning against clinton. if they leave the convention as hosed up as they are now, i wouldn't be surprised to hear Senator Turtle make an immediate 180 and start working towards Garland's confirmation.
