"Can you be given a pardon if you have no criminal record or even any charges filed?"

Yep. Obama could pardon her for any federal crimes she may have committed, but my understanding is that he does not have the power to pardon her for any state crimes, e.g. anything to do with the Clinton Foundation as it may pertain to violating certain state statutes. In the first case, she does not have to have been indicted to receive a pardon.

It was always going to be either impeachment or jail for Hillary... Thankfully she lost.

This is probably the reason why Obama is sooo P Od though. His legacy after 8 years in office will be reduced to 7 very small words.... Obama was the President who pardoned Hillary. That's because without his pardon she will surely go to jail, and Hillary is the sort of criminal who after being caught will likely drag as many as she can down with her in an effort to avoid hard time.

Obamacare, eliminated or modified to the point of non-recognition. Pretty much every other so-called 'accomplishment' wiped out with the stroke of pen, since they were all pretty much accomplished with one. Hopefully his melancholy doesn't become clinical or dangerous... After all, until January20th he still is the President and Commander in Chief.

OK this will rub against the grain.

First I think she is guilty as hell.

All military and civilians that handled classified information know what the penalties are for mishandling.

She was negligent about security at Banghazi both before the killings of the Americans and in any attempt to rescue them. So was her boss.

Her hearings should proceed up to the point of referral of charges if warranted.

The world is watching and at this point when her guilt is clear it may be wise for Trump to decline to prosecute, not pardon her. To prosecute a political opponent would be viewed as a vendetta, not the pursuit of justice.

The best possible alternative would be for obummer to pardon her before leaving office. That leaves the shadow of guilt over her and the political burdon of the pardon on obummer.

They’d better knowing what she, and her cohorts on the left have in store for us.

IF we think these alleged “protests” organized by the left that are currently happening across the nation are outrageous, we haven’t even seen the worst they will be throwing at us trying to force America to compromise with them.

This is war, and we have to recognize it is nothing less than war. The left made their move towards their final solution during the Obama tenure knowing they had no chance of winning after his eight years without an all out war on the constitution, and the Republic that exists because of it.

I hate to say it, but it would be best for our side if Obama pardons her. Then history can blame him, but the Trump administration is relieved of a a no-win issue.

He has MUCH BIGGER FISH TO FRY. Like building a wall, reversing Obama Executive Orders, lowering corporate taxes, setting up tariffs on companies like FORD, cancelling funding to U.N. (especially climate), stopping Iran nuke deal, getting Justice(s) confirmed, changing the geopolitical landscape in ways the globalists will HATE (like working with Putin to destroy the Saudi/Qatar/Clinton creature: ISIS) and many more.

Maybe some of the criminals the Clintons sold influence to will come after their money, since she can no longer deliver the goods.

I agree. I said that I never thought Trump should have said he would look into her situation. Sure, it sounded great on the campaign trail and the crowds loved it, but is it really something he wants to waste political capital and time on? He wants to unify the country (which I think can only be done to some extent), and that’s going to cause a lot of controversy and division. However, now that he has said he is going to do it, if he doesn’t do it, there will be supporters (not me, but some) who will feel he’s not keeping his word. There is also the whole point of draining the swamp and some people being “too big” for prosecution - meaning that someone who wasn’t Hillary Clinton would be in serious hot water for what she did.

If Obama pardons her, Trump can just say that his hands are tied. There is nothing he can do about it. He won’t have to worry about any controversy or division. He can focus on jobs, immigration, healthcare, etc. Obama will be hated by the same people who already hate him and loved by the people who already do.

It will be interesting to see what Obama does, but I think he will. We can’t know for sure. I think he is salty over what she did with her emails as SOS. Remember that Wikileaks showed Obama knew that she had a private email. This is contrary to what he said about learning about it on TV. This case could involve him, and so that would be a reason to pardon her. On the other hand, her email situation may have cost him his legacy because it ushered in Trump. That could be reason to not pardon her.

Again, though, I agree it would be easy for our side if he does.

Sometimes on this FreeRepublic forum I wonder if there are some who would’ve preferred for the USA to have a Constitution like Poland had in the 1790s rather than what the USA got to replace the Articles of Ceonfederation. In Poland every member of the Sejm had Liberum veto power where at any stage of a session they could shout “Nie pozwalam” which would mean an immediate end to the current session and nullification of any legislation that had already been passed. Thus the legislators could stay true blue to their principles and never cave in on anything.

Well it turns out that the leaders of Russia, Prussia, and Austria had their own principles too. They wanted a weak Poland and to partition her boundaries amongst themselves. So they bribed members of the Sejm to shut down any progress and Poland surely decayed and fell into 120+ years of disappearance from the map of Europe.

One of the key components of the USA Constitution is the Principle of Compromise. This is part of what has made the USA the greatest nation in world history as far as I’m concerned. How many of the Freepers are true to this principle? Or how many are dogmatically stubborn where it has to be their way or the highway? If America is to be Great then its leaders must compromise effectively. Then freedom may reign for the rest of our days and that of our grandchildren.

Don't malign Grant. He was a genuinely good man who trusted the wrong people, and his first term was actually above average for that era of Presidents.
