is removing Iraq supposed to get around the courts somehow?

doesn't even makes sense. The Iraq consulate was disrupted for a while when ISIS was on the move and didn't handle refugee applications for a while, people had to make their way to consulates in surrounding countries to apply for refugee status.

I guess Iraq has a major US military presence so they think it has already been doing a better job of vetting?
