The reverse is also true. The real solution is the law being fixed by the legislature, unless that was the outcome they desired. I mean Congress has amended or passed new laws because they didn't like what occur as a result of the way the law was currently written and the courts ruled. For some reason I feel like this is how the federal torts claims act (or something similarly named) came into being.

No they were not legally required to and most people's "affordable" plans that they pine for in 2009 and earlier had next to no coverage besides catastrophic and even then there were laughable lifetime caps of poo poo like 25k.
