The way it works now, any ICE agent can issue a hold on a suspected illegal alien without a court order. The local police force is then required to keep that person in custody at their own expense, and if the ICE agent hosed up and the person sues then the local municipality is on the hook for any lawsuits. Sanctuary cities are basically saying, "gently caress you, do your own job and accept the liability for it when you gently caress up." If ICE was getting court orders for these detainer holds it wouldn't be an issue. Cities would be forced to follow court orders. But ICE wants local police to detain people any time an ICE agent has a hunch and says, "Juan Gonzalez... that name sounds familiar... hold him!" Sanctuary cities supposedly also have the advantage of making policing easier because illegal immigrants are more willing to engage with the police, but I don't know if that's backed up by any actual studies. Rank and file police usually oppose Sanctuary cities because they are fascists. There has always been an easy way to drastically reduce illegal immigration: prosecute the people that employ undocumented immigrants. Unfortunately, that option rarely gets implemented because the people that employ undocumented immigrants are the people that finance our politicians.
