That's pretty standard across the country. Once the person is arrested for DUI/DWAI, they're taken back to the precinct where a regularly calibrated breathalyzer is used. That's admissible in court. They can also do blood draws there, and those are admissible as well. AFAIK, you can't refuse those as they are taken incident to the arrest. At the end of the day: All this talk about the tests doesn't matter: He wasn't the perpetrator, he was the victim of the perpetrator, so there was little to no justification for the cop's need nor desire for a blood test. The proper thing would've been to get a warrant if he needed it, but he wouldn't have gotten it. Let alone for him to go on a power trip and attempt to arrest a fully justified ER Nurse. Almost all states suspend your license for a similar if not the exact same amount of time for an above limit blow as well, thus making If you are ever suspected of a crime your best bet is to not provide anything at all to police without a lawyer's advice. Go talk to a DUI lawyer in your jurisdiction and ask them for more locally tailored advice, but i'm almost certain it will match what i'm posting. First and foremost rule, though, is don't drink and drive. That's the best way to avoid a DUI.
