I think you will find that Skadden will kick the doors right off the hinges with this as their opening argument. There would be no Star Citizen and no $170 Million dollars in record crowdfunding without Crytek's generosity and willingness to do good business. CIG has a rather interesting history of loving over every single person they have done business with and that will be reflected. On a strategy level alone, Skadden is playing a very straightforward and conservative game waiting for CIG to make their own mistakes and then capitalize on them. I think that Skadden is going to use the Legal equivalent of Aikido here and let use everything CIG has against itself which is already evident in the over the top response from them right out of the gate by adding evidence to something that required none. There is no question in my mind how badly CIG is going to lose, I am just interested in the strategy and skeletons that are going to come flying out.

Yeah, you are drafting a defense, it's obvious you don't think the claim should have been brought. All this level of bluster does is show incredible professional rudeness to the other side's counsel - when you both know that you are paid advocates trying to present the best possible case for your clients.

Rudeness does not make people want to believe you, which is a problem when your job is to be persuasive. This is why people have been assuming that Ortwin or Roberts dictated parts of the letter or gave instructions that a good press line was more important than the best possible legal defense - good lawyers just wouldn't have written that.

I guess, but sometimes bluster can be indicative of just having a terrible case too. I mean, sure it's rude to your opposing collegue, but if you have nothing you had better start pounding the table before looking hard at your settlement options. I've had to do it a few times, however I don't ever let clients put words in my mouth. I'm not that lazy, nor am I that stupid.

I don't do contract law and none of -my- contract law is pertinent to this so I can't really comment on the content, but from the cirumstances of the case I'd say it's fairly likely that Skadden (who by the way are a very, very, very serious and competent law firm) are absolutely certain of their case. Although, it does seem obvious to motion for a dismissal even if you've no chance of that happening maybe just to keep your client happy (you can always blame the judge when your rainmakery falls through). Sometimes it's just because you're short on time and do the shotgun approach, just do whatever you can, throw everything at the case to see if anything sticks. That's usually a desperation tactic.

As the kind of nerd who will actually enjoy the litigation drama more than anything else itt, I'm looking forward to see where it goes. I hope not to settlement, but if there's avenues of appeal and things can be drawn out I'd expect CIG to try and stall this for as long as they can, to sell the maximum amount of pixels first.

It's kind of funny, but people who don't know anything about law or legal processes routinely try to trash talk their opponents like they think it's a popularity contest or a trash talking contest or something. I suppose that stems partly from frustration and fear of the unknown in the process, but probably also a lack of understanding: The legal process is supposed to take as many emotions and counterfactual claims and badmouthing as possible out of the entire deal, because "first, always seek compromise". Compromise is impossible if basic civility isn't observed. There's also the problem with people really only seeing the "arguing in court" part of law, which blinds them to the gigantic machinery below the hood setting up the entire premise for even having a hearing, the underlying law that is implicitly accepted by all parties and thus at the outset excludes 99% of potential arguments. Instead, they think "oh it's the guy who sounds the most convincing to the judge who wins, guess we need to be louder and also make the judge understand that my ex-wife is a bitch". Also, people are just too loving stupid to shut the hell up and realize they have no power to affect the outcome in any real sense and can't possibly help their case by getting all tribal.

Then again, I usually never try to explain any of that because people don't want to know and don't care. "Just fix it". Well, I guess the system beats blood feuds.

I know what you mean. I once had a Chrysler 300M. Always wanted the car, because I liked the bodywork. I wouldn't say I miss it, but there was nothing very special about it regarding engine and stuff, and quality-wise, it was sub-par, but I still liked that car very much....it was a cool and good cruise machine which I enjoyed very much. Imo, a car doesn't have to be the fastest, most flashy rocket on the road to be cool and good. If it has character and you like driving it, it can be the slowest rustpiece there is, as long as it's fun.

Imo, it's very similar to games (bear with me). A game does not need a breakthrough concept, kick-rear end graphics or never before seen features to be simply a lot of fun. That's one of the things I'll never understand about Star Citizen. The shitizens marvel in their fidelity, like it's an important part, but let's be honest: graphical fidelity stopped beeing important like five years ago, because we are at a level where it is hard to have a true jaw-dropper. Give me fun gaming mechanics and a game I simply like, and it's cool and good. Just played FF VI again over christmas, and everytime the Celes theme starts to play, it brings goosebumps to my arms, simply because the game overall is so likeable and cool and good, similar to stuff like Undertale etc. That's why I pity the shitizens, because they are in an eternal search for "maximum fidelity", "maximum play area size", "maximum whatever" instead of a game that is likeable.

Then again, it's hard to find such games nowadays, most of them actually come out of the indie scene, though Divinity 2 and Hellblade are a perfect example that they don't have to rely on 8/16-bit graphics.

Ha, yeah right. This game isn't coming out in 2018 and I'd be surprised if it comes out in 2019, either. At this point, with no end in sight and a lawsuit hounding RSI, it's possible this will be the most expensive vaporware of all time. Hope everyone is enjoying their digital space ships that may or may not ever be part of an actual game. I mean, I really do want this game to succeed and be amazing, but it's starting to look more and more like a myth. Like, which will release first: Half-Life 3 or Star Citizen?

Nice to see Forbes is doing their part to keep “Star Citizen is vaporware” in the upper ranks of autocompletes for “Star Citizen is...” searches.

I don't think you need to bother at the moment, it was funny but pretty much everyone has seen it. In future years copies of anything from the failed Star Citizen project might be worth money though.

Also if you are going to rehost something that CIG wants off the internet and are worried about tips for concealing your identity, maybe don't ask for advice on how to do it in the only thread on SA that CIG avidly reads.
