Does the neighbour get any partial claim on the value of your tree? What if the neighbour hates your tree, but isn't quite dumb enough to cut it down - could they just dig a big pit in their land which happens to cut through your tree's roots? Or build a pool there and claim for damages when the roots grow into it?

Whoever has the trunk owns the tree and the fruit on that tree (although not always the fruit fallen from that tree and onto your land, that varies). The pool thing could work, I guess, if it worked out that way, but that's an awful expensive "solution." You're allowed to cut back roots if they're endangering your poo poo in most states, but not to the point where it'd kill the tree. Same with limbs. If the trunk is on both sides, the tree belongs to both of you and both of you must consent to anything being done to the tree.
