BWM: Signing a cognovit note (AKA confession of judgment) in order to get a loan. A confession of judgment is a legal document that effectively says "I give up my right to respond or contest to any civil suits relating to this debt." With it, a creditor can get an immediate verdict for a civil suit without having to follow due process. It's an arbitration agreement where borrower loses before the arbitration begins.

Living in a van is something you do for one of two reasons 1. You have lost most of your worldly possessions and are one tow truck away from homelessness 2. People with some spare cash, aged 22 to 29, want to be More Interesting Remember the BFC Goon who wanted to live in a houseboat to save money?

That's why most states do not accept cognovit notes. PA and NJ courts will accept them, but they usually are not friendly towards creditors with cognovit notes. NY courts, however, just don't give a gently caress.

For those people in that neighborhood the switch to down coats might actually be GWM, they no longer have to maintain a collection of more expensive furs.

As another poster mentioned, they're not accepted in many jurisdictions, but NY doesn't give a gently caress. In general, small businesses can get really hosed with unfair contractual terms, since they're often understood by the courts to be savvy enough to avoid predatory deals (because they're not consumers). Of course this doesn't account for the differences in bargaining power that exist even among businesses, and we end with this.

I'm sitting here in Europe, scared about US debt. US national debt is a tricky subject because our unique position in the world coupled with low interest rates means it’s not a problem like say, Italy with its recent deficit talk. Rising interest rates are a problem along with the fact we’re running trillion dollar deficits while in our second longest economic expansion ever. At this stage during our longest economic expansion ever we were looking at hundreds of billons in tax surpluses. The next recession is going to be absolutely brutal on our balance sheets. And the math is pretty simple. We’re going to have to raise taxes.

It's entirely possible to "fix" if we taxed the wealthy appropriately, stopped letting corporations hide their profits, and scaled back our absolutely over the top military spending.
