From what I read, and I am not a lawyer, it wasn't against the law in the first place. As hosed up as that is, you can't bring charges against them. A key tenant of our justice system is that the law must be recorded prior to the crime. Otherwise (based on half remembered criminal justice classes from 10 years ago) we would be know better than the English, who had a habit of prosecuting people for things that weren't a crime at the time.
