Justice Department Indicts Judge Who Helped Immigrant Evade ICE In Her Courthouse

Thursday’s charges stem from an incident on April 2, 2018, when Joseph held an arraignment hearing for Jose Medina-Perez, who has resided in the United States unlawfully. Medina-Perez had been arrested on drug charges by police in Newton, Massachusetts, where Joseph presides. Prosecutors initially believed he also had an outstanding warrant for drunk driving. But on April 2, Assistant District Attorney Shannon Jurgens concluded that Medina-Perez was not the individual named in the warrant. She also declined to request that the state hold him the drug charges. So Joseph ordered him released.

That’s when the trouble began. Joseph and the attorneys were aware that a plainclothes ICE officer was present to arrest Medina-Perez once the hearing concluded; the judge had asked him to wait outside the courtroom. Before releasing him, Joseph held a sidebar with Medina-Perez’s attorney, David Jellinek. She asked Jellinek, “ICE is gonna get him?” She then asked him “What if we detain him?” Then she had the court recorder turned off for an “off the record” conversation, in apparent violation of the Massachusetts Rules of Court. After the recording resumed, Joseph ordered Medina-Perez released. MacGregor escorted him to a backdoor exit, avoiding the ICE officer just outside the courtroom. Medina-Perez left, successfully evading arrest.

I hope this clown doesn’t have a huge stash of weapons in his house. Cause when you’re about to go to jail for years seems like a good motivator to just go through with your crazy plans cause you’re hosed already anyways, might as well be a martyr.

This is a really really really really really really big deal. This is the federal goverment physically asserting it's power and dominance over state courts. That's like, a really goddamn big deal.

The law doesn't matter anymore if the law somehow conflicts with the goals of evangelical white supremacism in the United States. This is the reality we now live in.

And because our entire population has been trained to wait for either Heroes to appear and fight this on our behalf or four leadership from within the existing system to tell us what to do- we're all sitting around with our thumbs up our asses while it becomes all the more obvious that we are living through the rise of fascist America.

We need to start seriously discussing general strikes and intentional (non-violent) disruption of supply chains- that's the only chance the good guys have at this point in time. Our elaborate system of checks and balances is nothing but a wall of sand being not-so-slowly eroded away by the ongoing storm. The Democratic party's existing leadership structure is severely compromised by corporate actors and the interests of big capital- it is completely impossible for a leadership figure capable of truly opposing fascism to appear from within that structure.

We average Americans need to start looking to ourselves to solve this problem, and the longer we wait to have that conversation that's less likely it'll happen in time to matter. The concentration camps are open, we're talking about sending forcefully orphaned children to a foreign concentration camp basically just for shits and giggles, we're releasing white supremacists who are plotting political assassinations of opposition figures, the White House is asserting itself as above the law (and doing so successfully), and the federal court system is asserting its dominance over state court systems by slapping federal indictments on state judges for the crime of doing their jobs.

It's not too late but we ain't got a whole hell of a lot of time and we need to start thinking about how we average people can fight this poo poo on our own because the system sure as gently caress ain't going to save itself at this point.

Uh, he's white. You can't take things from a white person, A TROOP, without a trial. Also, there's no way this guy knows any illicit ways to get guns, thankfully. Gun sales are well regulated and there are no obvious loopholes like gun shows or private sale that bypass all monitoring.

Yeah he could go to jail if he leaves his house, but unless U.S. Marshals are waiting to immediately tackle him it wouldn’t do much to stop him going on a rampage.

They are showing you that they are above the law and daring anybody to do something about it. If they get away with this then they will just escalate three or four months down the line.

Rinse and repeat until either an external force stops them or the ashes of minority's darken the skies.

Because a video of Trump's underlings describing crimes is far more effective than text of them doing the same.

The Republicans absolutely understand that this poo poo is impactful that's why they are doing everything in their power to prevent or at least delay it. There is also the idea that they are trying to run out the clock and get as close to the election as they can before poo poo blows wide open in the hopes that the reckoning can be deferred until it's too late. Then either they manage to maintain power through their usual dirty tricks and Russian help or he resigns right before inauguration so Pence can pardon him and he can gently caress off to Russia before he's indicted on State charges possibly loving off to Russia before the resignation and pardon.

The Democrats most of them being the risk averse cowards that they are don't want to go full bore for fear of it back firing. There is also the whole question of whether the courts will follow precedent or make poo poo up to protect the orange shitstain and his enablers. After all it's not like congress has it's own army and as long as the Senate maintains solidarity with Trump there isn't that much that the Democrats can really do beyond talk.

I mean what happens if they send the Sgt at Arm to arrest Miller and end up in a stand off with the Secret Service? It's not like they're going to have a shoot out in the White House.
