Until now the previous PM resigns and the new one almost immediately visits the queen to be given the office. But Boris could just resign and leave the country leaderless on the 19th, so Benn's bill cannot apply as it requires the 'Prime Minister' to perform the actions, and unless the house can grant someone confidence, the bill would be unenforceable.
