Article 1, Section 3 posted:

The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Founders didn't have a lot to say on the Supreme Court so they probably thought 'yeah sure, Chief Justice presides, sounds legit.'

It's more or less karma in question form.

The CJ in a Senate trial is essentially useless as all the Constitution really says is that the CJ "presides" and that's about it. The CJ can be overridden by a simple majority vote by the Senators, so it's very clear that the Senators really run the show. It's really a trial in name only.

With that said, Democrats want the CJ to sack up and make some common-sense decisions about poo poo like witnesses. The CJ's role in impeachment trials is vague, so they want him to be more activist instead of the Rehnquistian potted plant.

Really, it's kind of a cheap shot by Warren, as arguably the CJ should be deferrential. But gently caress him with every dick in the world though for all the dumb bullshit he's pulled at the Supreme Court.
