The plaintiffs could appeal to circuit and try to get it remanded with their standing established, but that will take time. And by giving that unofficial ruling on the merits, he may be signaling the plaintiffs that it's not worth their time to do that.

Now that's it's over and I don't have to be superstitious about it: let's be clear about this suit - it was not brought by RPT or any county Republican party. I'm sure everyone of them would've loved to see those votes get tossed but not a one said anything in support. This was Steve Hotze, whomst tweets you saw earlier, one crackpot state Rep and a couple of Harris Co. lawyers. The tenor of the coverage did not match the seriousness of the challenge, something to keep in mind when we see breathless tweets about alarming things from national mag reporters. There was no loving way a federal judge was going to toss more than 100k votes already lawfully cast - especially after two challenges were dismissed by the state supreme court.
