Fair Work Commission just knocked back BHP's vaccination mandate for the Hunter Valley mine:

BHP is the first company to mandate vaccines and have that decision overturned. All challenges to public sector jab mandates so far have failed.

The commission’s decision does not mean other private sector vaccine mandates, such as at Qantas or Telstra are invalid, but shows they are open to challenge on a case-by-case basis.

BHP’s mandate was challenged by the mining and energy division of the Construction, Forestry, Maritime, Mining and Energy Union, which represents workers at the Mt Arthur mine.

I'm curious what "consultation obligations" mean. How much notice would they need to give their staff? Mines probably wouldn't be subject to the same restrictions as hospitals and schools, but wouldn't they just make their vax-by dates the same dates that are state-mandated for other areas?

Depends on what their eba says or if they even made any attempt to even pretend to consult. This has nothing to do with the mandate itself, it’s a company ignoring its obligations to its workers and getting slapped for it.

Despite what many of them seem to think, companies can’t just make significant changes to conditions without at least appearing to consult with their employees.

and "consult" doesn't mean "agree with", companies just have to have a mechanism to find out the views of the workforce and show that they've been reasonably considered.

It's a really low bar to step over, yet BHP couldn't even do that.

Had a small symptom so had to go get tested. 2.5 hour wait because multiple schools in the area had to get entire years tested. Last time I got tested the wait time was about 30 minutes.

I know it's because the US right has decided to use Australia as the posterboy for "freedom hating lockdown happy communists".

But poo poo like that cartoon make less and less sense as Aus. opens up. Mask mandates are being eased, borders are being opened. People can fly overseas on holidays now, (to places like Singapore and Fiji). The freedoms the cartoon says we don't have are being experienced more and more.

So, it's almost as if the US right wing propaganda machine does no research and cares little about actual facts or conditions in real life.


Unrelated Omicron-COVID being a bastard to me personally news. Japan have actually closed their borders for the entire month of Dec. and possibly further because of it. Which affects me as I had got my working visa and done all the work to fly over there on the 20th. Plans which now are in shreds as I have to get ticket refunds etc. whilst being stuck in my parents spare bedroom for at least yet another month. YAY.
